Office for Complaints concerning insurance intermediaries (§365z1 of the Austrian Trade Act, Directive 2002/92/EC)

The Office for Complaints concerning insurance intermediaries is part of the Federal Ministry for Digital and Economic Affairs (BMDW). Under §365z1 of the Austrian Trade Act (GewO), this Office must accept, free of charge, any complaints registered by customers and other interested parties, especially consumer associations, regarding insurance intermediaries.

In all cases complaints are to be processed and receive replies. Wherever possible, the Office has to use redress procedures for the out-of-court settlement of disputes. Any incoming complaints about credit institutions and insurance companies acting as insurance intermediaries are to be reported to the Financial Market Authority (FMA). The Office for Complaints has to cooperate with comparable bodies of other Member States in the resolution of cross-border disputes and to encourage cross-border cooperation between other complaints and conciliation bodies.

If required, complaints are to be processed in cooperation with consumer associations. Depending on the issue of complaint, the Office for Complaints will align complaint processing with other bodies or will refer the complaint to the competent authority for resolution.
